Terms of use for Peak Atlas

These terms of use govern the use of the Peak Atlas platform at app.peak-atlas.com and the applications, functions and services provided through it.

2. Scope
These terms of use apply to the use of Peak Atlas by entrepreneurs, companies, organizations and persons acting in the course of their professional or commercial activity.
Peak Atlas is in principle not aimed at consumers within the meaning of Section 13 of the German Civil Code (BGB), unless expressly agreed otherwise in an individual case.
Deviating terms of a user apply only if Peak Atlas has expressly agreed to their validity. Individual agreements, quotes or orders take precedence over these terms of use in the event of conflicts.
3. What is Peak Atlas?
Peak Atlas is a digital business and operating platform for entrepreneurs, companies and teams. Depending on the booked or unlocked scope of functions, Peak Atlas can in particular enable users:
- to organize work, tasks and projects,
- to manage company information centrally,
- to use business applications and tools,
- to structure content and knowledge,
- to search and evaluate information,
- to use AI-powered features,
- to connect external services and data sources,
- to set up workflows and automations, and
- to manage multiple teams, organizations or companies within one shared system.
Which functions are specifically available to a user depends on the product, plan or workspace unlocked in each case. Some of the functions mentioned are still in development and are labeled accordingly.
4. User account
A user account is in principle required to use protected areas of Peak Atlas. Users are obliged to keep the information provided at registration correct and up to date.
A user account may in principle only be used by the person for whom it was set up, unless Peak Atlas expressly permits other use.
The user is responsible for the security of their access credentials and must inform Peak Atlas without delay if there are indications of unauthorized access to their account.
5. Sign-in with Google
Peak Atlas allows sign-in via Google Sign-In. In this case, Google is used to authenticate the user.
Using Google Sign-In does not mean that Peak Atlas gains access to Gmail, Google Drive, Google Calendar or other Google services. Additional Google services are connected only if the user expressly activates a corresponding function and grants the required permissions.

6. Organizations and workspaces
Peak Atlas may enable use within organizations, teams and workspaces. Depending on the respective permission system, administrators of a workspace can in particular:
- invite and remove members,
- assign roles and permissions,
- unlock applications,
- configure integrations, and
- manage organization data.
Users who join a company or organization workspace acknowledge that authorized administrators of that workspace can manage certain settings and content within the workspace.
7. Users' obligations
Users may only use Peak Atlas in accordance with applicable laws, these terms of use and the intended purpose. In particular, it is not permitted to:
- to process unlawful content via Peak Atlas,
- to infringe the rights of third parties,
- to distribute malware or harmful code,
- to circumvent security mechanisms,
- to gain unauthorized access to third-party accounts or data,
- to disrupt or excessively burden the platform,
- to make automated access in violation of the technical interfaces or restrictions provided,
- to use Peak Atlas to carry out fraudulent or abusive acts.
Users are themselves responsible for being entitled to process and transmit the data they bring into Peak Atlas.
8. User content
In principle, users retain all rights to the content they bring into Peak Atlas. The user grants Peak Atlas only the rights that are technically necessary in order to:
- to store content,
- to process it,
- to display it within the authorized workspace,
- to perform the requested functions, and
- to provide integrations or automations activated by the user.
This grant of rights is limited to providing Peak Atlas. By using the platform, Peak Atlas does not acquire ownership of the user's company data or content.
9. External integrations
Peak Atlas may offer interfaces to third-party services. These may include, for example, authentication, productivity, communication, data, analytics, CRM, e-commerce or other business services.
In principle, the user decides for themselves whether such an integration is activated. For third-party services, the respective terms and privacy policies of the third-party provider apply in addition.
Peak Atlas has no influence on the permanent availability or functioning of external services. If a third-party provider changes or discontinues its interface, an integration may have to be adapted, restricted or discontinued.
10. AI-powered features
Peak Atlas may provide functions that use artificial intelligence or machine learning. AI-generated results may contain errors, inaccuracies or incomplete information.
The user is responsible for independently verifying relevant results before making a business, financial, legal, personnel or other significant decision.
To the extent Peak Atlas uses external AI service providers, the content required to carry out a specific request may be technically transmitted to these service providers. Further information is contained in the privacy policy.
Peak Atlas does not guarantee that AI-generated content is complete, error-free or suitable for a particular purpose.
11. Automations and actions
Peak Atlas may offer functions with which users can automate actions or trigger actions in connected systems. The user is responsible:
- to review automations before activating them,
- to configure permissions appropriately,
- to monitor particularly critical actions, and
- to ensure that automated processes are lawful.
If a function requires express approval from the user, Peak Atlas will only carry out the action in question after such approval.
12. Availability and further development
Peak Atlas is continuously being developed. Functions may be improved, changed, supplemented or replaced, provided this does not unreasonably impair the main service owed under the contract.
Peak Atlas may be temporarily unavailable, in particular due to:
- maintenance work,
- security measures,
- technical faults,
- failures of external infrastructure or
- events beyond Peak Atlas's control.
To the extent specific service levels have been agreed, they take precedence over the general provisions of this section.
13. Beta and experimental features
Peak Atlas may label individual functions as beta, preview, early access, experimental or similar. Such functions may still be in development and may be changed or discontinued at any time.
Unless expressly agreed otherwise, there are no special availability or functionality guarantees for such functions.
14. Prices and payment
Individual functions of Peak Atlas may be offered free of charge or for a fee. Prices, billing periods and scope of services are set out in the respective quote, plan, order process or individual contract.
If recurring remuneration is agreed, it must be paid for the respectively agreed billing period. Unless otherwise stated, all prices are exclusive of the applicable statutory value-added tax.
15. Term and termination
Term and notice periods are set out in the respective plan, quote or individual contract. Free user accounts can in principle be terminated using the functions offered within the platform or by email to us.
Peak Atlas may block a user account or terminate the user relationship for cause if:
- a user uses the platform in a significantly abusive manner,
- essential provisions of these terms of use are violated,
- a use infringes third-party rights or statutory provisions, or
- a block is necessary to avert significant security risks.
Where possible and reasonable, before a permanent block the user will be given the opportunity to remedy the condition complained of.
16. Data export and termination
To the extent Peak Atlas provides corresponding export functions, the user can export their data before the user relationship ends.
After termination, data is deleted or anonymized in accordance with the privacy policy and statutory retention obligations. For business-critical data, the user remains responsible for making any necessary backups and exports of their own.
17. Rights in Peak Atlas
The software, design, trademarks, logos, content, data models and other components of Peak Atlas belong to Peak Atlas or the respective rights holders.
For the duration of the user relationship, users are granted a simple, non-exclusive and non-transferable right to use Peak Atlas to the contractually intended extent. The following in particular are not permitted:
- unauthorized reproduction,
- sale or sublicensing of the platform,
- reverse engineering, unless this is mandatorily permitted by law,
- removal of intellectual property or copyright notices.
18. Feedback
If users voluntarily submit ideas, suggestions for improvement or other feedback to Peak Atlas, Peak Atlas may use this feedback to improve and further develop the platform. In principle, this gives rise to no claim to remuneration or to implementation of a suggestion.
19. Confidentiality
To the extent users and Peak Atlas gain access to confidential information of the other party in the course of the user relationship, it must be treated as confidential. Information that is not considered confidential is information that:
- are generally publicly known,
- were already lawfully known to the receiving party,
- were lawfully obtained from a third party, or
- were developed independently.
Statutory disclosure obligations remain unaffected.

To the extent Peak Atlas processes personal data solely on behalf of a business customer and the prerequisites for this are met, the parties may additionally conclude a data processing agreement.
21. Warranty
Peak Atlas is provided with the quality and functionality agreed in the respective contract or plan. No software system can be completely free of errors or operated permanently without interruption.
Peak Atlas is entitled to fix technical errors within a reasonable time. The user's statutory rights remain unaffected, unless they have been effectively waived or restricted by contract.
22. Liability
Peak Atlas is liable without limitation:
- in cases of intent and gross negligence,
- in cases of damage from injury to life, body or health,
- under mandatory statutory liability provisions, and
- to the extent a guarantee has been expressly assumed.
In the case of slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical for this type of contract. Any further liability for slight negligence is excluded, to the extent legally permissible. Mandatory statutory liability provisions remain unaffected.
23. Changes to these terms of use
Peak Atlas may change these terms of use if there is an objective reason for doing so, for example due to new functions, technical changes, new legal requirements or changes to the platform structure.
Material changes will be communicated to users in an appropriate manner. Where express consent is legally required, the change takes effect only after corresponding consent.
24. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent legally permissible.
If the user is a merchant, a legal entity under public law or a special fund under public law, the registered office of Peak Atlas is the place of jurisdiction – to the extent legally permissible.
Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions remains unaffected.
